An employee is going on FMLA / parental leave / extended absence. What happens to their health coverage?

Federal law requires employers to maintain health coverage during FMLA leave on the same terms as if the employee were working. Premium contributions continue — typically the employee pays their share (the employer bills them) and the employer pays its share. State equivalent leaves (NY PFL) usually carry similar continuation rights. After leave ends, if the employee doesn't return, COBRA kicks in. Document the premium-collection approach in writing at the start of leave to avoid disputes; some carriers also offer billing services to handle this directly.
