Is workers' compensation insurance required by law?

In most states, yes — and New York is one of the strictest in the country. Coverage is required as soon as you have any employee, full-time or part-time, W-2 or in many cases 1099 if the worker functions as an employee. Texas and South Dakota are the only states where private-sector WC is genuinely optional. Penalties for non-compliance are steep: in NY, civil fines run up to $2,000 per 10-day period of non-compliance, with criminal exposure escalating to a Class D felony ($10,000–$50,000) for repeat violations. WC is not the place to test whether you actually need coverage.
