Will the carrier settle a claim against my will?

It depends on whether your policy includes a consent-to-settle clause. Many physician-focused policies (especially those marketed by physician-owned carriers) require your written consent before the carrier can settle — you have the right to insist on a defense to verdict. Other policies, especially employer-sponsored group policies, give the carrier unilateral settlement authority. Consent-to-settle clauses come with hammer provisions in some forms (if you refuse to consent and the verdict exceeds the offered settlement, you may be on the hook for the difference). Confirm where your specific policy lands before a settlement decision is on the table.
