We received an EEOC / NY DHR / NYC CCHR charge. What do we do?
Report it to the carrier immediately, even before you respond to the agency. The agency response window (often 30 days for position statements) is short, and the carrier-appointed defense counsel needs to be involved from the first response — what gets written into the position statement affects everything downstream. Don't have HR or in-house draft the response without coordination; agency responses often become discoverable evidence in subsequent litigation. The carrier typically pays for the response under the policy's investigation defense provisions.
